Aloe Entertainment on Current Faith Based Productions

Most of the time when people think of faith based films they think of The Passion of the Christ, but what about current productions? Most recently to hit the box office is the film October Baby. Although this movie does not immediately appear to be faith based, the message is entirely so says Aloe Entertainment.
October Baby is a faith based drama about a college freshman that finds out she is an adopted survivor of an attempted abortion. The main message of the movie is against abortion and it highlights the unpleasant effects they can have, explains Aloe Entertainment. The movie also shows a resolution to the main characters turmoil’s through her faith and devotion.
Although originally produced in 2009, the movie The Mighty Macs did not hit the big screen until October of 2011, says Aloe Entertainment. This movie is based on the true story of Cathy Rush who was the head of her basketball team at her all girls Catholic college. It is a story of a women driven by her faith to not give up even when all the odds are not in her favor, explains Aloe Entertainment.
Also in 2011 was the movie Courageous, says Aloe Entertainment. The movie depicts the lives of four police officers, that when stuck with tragedy, struggle with their faith and their roles as both fathers and husbands. Aloe Entertainment points out that the movie embraces God's promise to "turn the hearts of fathers to their children, and the hearts of children to their fathers."
Last years block buster Soul Surfer was also a faith based film, says Aloe Entertainment. The movie focuses on a 13 year old Bethany Hamilton that was a champion surfer, until one night while night surfing she is attacked by a shark and loses her arm. Aloe Entertainment explains that despite her misfortune she does not give up her faith in God and in fact uses her faith to help her get back into the water and surf again.

Aloe Entertainment would like to point out that you have to have more than just a good idea when marketing your faith based film, but you have to research your idea and have a good business strategy. The world is full of great products that will never be sold because they lack the right business model and go-to-market plan.   Aloe Entertainment says the next step in successfully funding your film is the
marketing plan. Aloe Entertainment would like for you to know that you have to have a very direct sales pitch, one that carefully defines what you're marketing, a faith based film. Using a strategy called 'direct-to-user sales' by using ads, direct mail, catalogs, the internet, and telemarketing to help spread the word of your film. Aloe Entertainment also suggests that you develop a channel sales program through value added resellers, corporate resellers, and partnerships with other companies.

Aloe Entertainment would like to inform you that partnering with another company is one of the quickest ways to fund and produce your film, this is called business development. Partnering up with someone else is all about relationships, says Aloe Entertainment, in this business it pays to make friends. Business development is finding the right companies with whom to create win-win strategic partnerships. Whether it's an OEM deal, in which another company private label's your product, or a bundling deal, in which you bundle your products with those of another company, Aloe Entertainment assures you that partnering can lead to large sales with a minimum of effort.

  Now that you have your
marketing plan and are well on your way to developing a lasting relationship with your business partner it is time tofocus on sales. Aloe Entertainment would like to point out that as long as you have your marketing plan aimed at the right target market sales with be a breeze. Aloe Entertainment says it's about answering objections, adding value, creating new efficiencies, or helping a company save money by spending wisely. And it's about knowing what's working and what's not, being responsive to the street.

The last step is launching your film! Aloe Entertainment says that launching you film is like blasting off. It takes drive,
focus, tremendous willpower, far-reaching vision, and a great support team. Aloe Entertainment says to keep in mind that are other companies that you can outsource these projects to, to partner with. So don't get stressed out, if you follow these steps and have a well researched marketing plan and your film will be funded in no time.

Aloe Entertainment answers a FAQ on film funding

Q: Do I need a film business plan in order to obtain funding for my film?
Aloe Entertainment: A film business plan is based upon distribution analyses and marketing strategies that identify how your film can maximize revenues. Most filmmakers find that the information contained in the plan is incredibly helpful in creating either a private placement memorandum for investors or a grant proposal from non-profit funding sources.
Q: Is it possible to have both private investors and obtain grant funding?
Aloe Entertainment: It is possible to have both non-profit and for-profit funding for a film. However, this is extremely delicate and requires close consultation with an attorney with expertise in both areas.
Q: If I have a business plan, do I also need a PPM?
Aloe Entertainment: It depends. You should consult with an attorney to learn more about the laws in your state. In general, a business plan is acceptable if you have a small number of active investors, that is, people who actively make decisions for the production. If your investors are passive, with no decision making on the project, this may mean you have an offering of securities that requires a PPM. Even if you need a PPM, many independent film producers find that investors are intimiated by the heavy legalese in the PPM. A film business plan can articulate the strengths of a feature film or documentary very effectively. If investors are interested in taking the next step,  the PPM can then define the legal requirements.
Q: If I have a PPM, do I need a business plan?
Aloe Entertainment: A business plan can be incorporated into your offering memorandum in consultation with your attorney. This may make your PPM more accessible, and more understandable, to potential investors. Without the context of a film business plan, investors can find a 20-60 page legal document quite intimidating.

A legal guide for independent filmmakers by Mary Aloe and Aloe Entertainment

Business Structure for Independent Filmmakers

When starting any new venture, the first question an entrepreneur faces is how to organize the business structure; the same goes for independent filmmakers when setting up a production company says Aloe Entertainment.
Generally, for a film production company, you are best advised to set up an entity that will not only divide economic risk, but also allow you to separate your personal finances and responsibilities from those of the company explains Aloe Entertainment.

Although you may choose a sole proprietorship (just you, no special paperwork required to start), it is not generally advisable for a production company as you cannot spread risk or limit potential liability; that is, if your business ends up owing money, you could be held liable from your own personal assets says Aloe Entertainment.
Along the same lines, although a general partnership (you and one or more partners, usually via a partnership agreement) is easy to form because you don't have to file papers with the government, you are not automatically protected from personal liability and can be held responsible for your partner's (or partners') business debts as well explains Aloe Entertainment.

Accordingly, there are three main types of business structures that an independent filmmaker should choose from:

Limited Partnership (LP): An LP is similar to a general partnership in that two or more people agree to form a working group, explains Aloe Entertainment, but in an LP there must be at least one "general partner" who is jointly and severally liable for the LP's debts and liabilities; the rest of the partners can be "limited partners" with limited liability.
Limited Liability Company (LLC): An LLC is owned by its members, who are not personally liable for the LLC's debts and liabilities. Taxation occurs on the individual member level (the same as in a sole proprietorship, general partnership, and S Corp., below). This is an increasingly popular option for film production companies says Aloe Entertainment.

Corporation (S Corp., C Corp.): A corporation is owned by stockholders or shareholders, who are not generally personally liable for the corporation's debts and liabilities explains Aloe Entertainment. An S Corp. can only have 75 stockholders or fewer, while the number of a C Corp.'s stockholders is unlimited, but the latter is subject to "double taxation" (first on the corporation, then on the individual level).
These may not cover the only considerations in your specific situation, however, Aloe Entertainment says it is important that you receive sound legal advice on this point before choosing a business structure for your film making company.

Intellectual Property Rights

"Intellectual property rights" refer to property rights over creations, including screenplays, motion pictures, sound recordings, and more. The types of intellectual property rights most important to independent filmmakers are those concerning copyright, which gives the copyright owner the rights to reproduce, adapt, arrange, perform, display, distribute, or sell copies of the work, among other things explains Aloe Entertainment.
Gaining a copyright over a screenplay is simple in that you only must put the idea into tangible form (typing or writing it will do); however, unless you have registered the copyright with the US Copyright Office. A registered copyright is generally valid for 70 years beyond the life of the author or from the death of the last living author (if there is more than one).

Another note regarding copyright and film making: you should be certain not only to protect your own work, but also to make sure you're not infringing on the copyright of others as you begin a project says Aloe Entertainment.

Other Legal Issues to Consider

Aloe Entertainment says to remember that as an independent filmmaker, you are likely to encounter many other legal issues as well, particularly those regarding contract and employment law, so be sure to consult an experienced attorney to help guide your decisions.
